Shameless intimidation by the court

Last October, I filed with the District Court for Prague 1 (judge JUDr. Dagmar Stamidis – quite a nice read about her work…) lawsuit for the protection of personality against the lies that Forum24 has been spreading about me for a long time (see older text).

Yesterday, certainly only by chance in the middle of the holidays, 40 days after the 30-day deadline set by the state, which the court has for this, the written notification of the negative judgment finally arrived (it was decided on 31.5. 2024).

I will completely ignore the fact that the judge did not actually deal with the evidence presented at all, and her reasoning is completely vague, and some passages quite regularly look like they were not written by an independent court, but on the contrary directly by the opposing party... But I would like to dwell on another, completely shameless thing and that is the "process" itself.

The judge could have written the rejection of my claim (as it is justified). ABSOLUTELY as well, without any make-up, because she did not reflect everything we presented. But she, on the other hand, gradually ordered 3 meetings, one of which consisted (literally) in the fact that she called us and said that next time she will deliver a verdict and that we should prepare for that, and now that she will have 14 days of vacation...

Every such action (even a completely unnecessary one) in court costs, of course, the fees of the opposing party's lawyer, and these are given by law. According to our rough calculations (consulted with other lawyers and lawyers + decision of the Supreme Court in this matter), the 4 procedural acts in this case should reach a total amount of max CZK 18,000.
But not with Judge Stamidisová, who assessed these 4 actions (in our opinion, completely illegally) at an incredible amount CZK 119,064, which I must pay within 3 days after the judgment becomes final.

That is, a completely wrongly calculated amount, which for a normal person is senselessly liquidating, and the judgment ends with a standard "threat".
"If the obligee does not voluntarily comply with what the enforceable decision imposes on him, the entitled party may demand enforcement."

If I want to appeal against everything in the judgment, including continuing to ask Forum24 to pay 4 million, I have to pay AGAIN 1% from the sued amount - so again 40.000,- CZK + this, in our opinion, illegal and senselessly calculated sum hangs over me CZK 119,064 – as payment of costs to the counterparty.

So friends, this is how the Czech court system works when a person wants to defend himself against the will of the media - as a natural person, he fights against a million-dollar media business, and the courts will give him the audacity to eat him nice and hard for daring to speak out against such a well-oiled system...

If you are not indifferent to what is happening here and you can, I would ask you if you would contribute to the lawsuit again. According to the amount that would be collected in the end, we would decide whether we would go for a complete appeal including non-pecuniary damage of 4 million, or we would only demand an apology + a change in the erroneous calculations of court costs.
Here, if it was just an apology, unfortunately Forum24 wouldn't be hurt at all and they would just keep laughing... I myself, as I already announced, would give up any winnings and donate it all to children's organizations.

I believe that there is a chance here - the court of first instance made the same wrong decision against ČT, but the appellate judgment, on the contrary, confirmed that we were right and CT must apologize and RNDr. Zuzana Krátká and a healthy forum!
